What Information is WebDesignSentral gathering about its visitors and
how is it being used?

When a visitor requests a page from within the www.WebDesignSentral.com website, our Web Servers automatically identify and log the HTTP request that is made to our Web Server. Terms of Service
TERMS OF SERVICE AGREEMENT FOR WEB SERVICES
Client Information:
Authorization. You (hereinafter referred to as "Client") is engaging WebDesignSentral.com. (Hereinafter referred to as "WebDesignSentral"), as an services company for the specific purpose of designing, re-designing or editing a website (hereinafter referred to as "Web Design Project") to be published on the Client's account on an Internet Service Provider(ISP)/Web Presence Provider(WPP) computer, hereinafter refer to as "Hosting Service", or provided as a zip file or on CD at the Client's option. The Client hereby authorizes WebDesignSentral to access this account, and authorizes the Hosting Service to provide WebDesignSentral with "full access" to the Client's account, and any other programs needed for this Web Design Project that are included as part of the Client's service agreement/level. The Client also authorizes WebDesignSentral to submit the completed Web Design Project to major Web Search Engines.
Development
WebDesignSentral performs contractor work remotely from a commercial office. WebDesignSentral is fully skilled to perform the project work and has the adequate skills to perform web design work.
Browser Compatibility
WebDesignSentral represents and warrants that the web site we design for you will work in:
- Microsoft® Internet Explorer versions 3 and up and Netscape Navigator/Communicator version 3 and up
While WebDesignSentral will make reasonable efforts to design a fully-functional web site, WebDesignSentral' warrantee does not cover AOL, text-based browsers or requested special effects that we have advised you against.
Copyrights and Trademarks
The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to WebDesignSentral for inclusion in the Web Design Project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend WebDesignSentral and its subcontractors from any liability (including attorney's fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Client.
Web Site Maintenance
This agreement allows for minor web site maintenance to pages over a 1 month period, up to an average of one half hour per regular web page, including updating links and making minor changes to a sentence or paragraph. It does not include replacing nearly all the text from a page with new text, major page reconstruction, new pages, guestbooks, discussion webs, navigation structure changes, attempted updates by Client repairs or Web Design Projects delivered to Client via zip file. The period of 1 month begins on the date the Client's web design site is available to be published to Client's hosting service or 30 days from the date this agreement was accepted online, which ever comes first. If the Client's web design package includes database access using Active Server Pages (ASP), then very minor page code changes will be accepted under this web site maintenance plan, major page code and/or database structural changes will be charged at then hourly rates. If new requests are added or more designs are requested then this project may need a new quote and may take longer to complete or cost client more.
Electronic Commerce Laws
The Client agrees that the Client is solely responsible for complying with any laws, taxes, and tariffs applicable in any way to the Web Design Project or any other services contemplated herein, and will hold harmless, protect, and defend Nicola Turner and WebDesignSentral and its subcontractors from any claim, suit, penalty, tax, fine, penalty, or tariff arising from the Client's exercise of Internet electronic commerce and/or any failure to comply with any such laws, taxes, and tariffs.
Web Design Project Copyright
The Client will be assigned rights to use the Web Design Project as a web site, once final payment under this agreement and any additional charges incurred have been paid. Rights to actual computer programs, software applications used and source code are specifically not transferred to the Client, and remain the property of their respective owners. WebDesignSentral retains the right to display a sample of clients Web design elements as examples of WebDesignSentral's portfolio. All Web Design Projects will have a small text link to WebDesignSentral' Design Services Web Site at the bottom of the webpage.
Completion Date
WebDesignSentral and the Client must work together to complete the Web Design Project in a timely manner. We agree to work expeditiously to complete the Web Design Project no later than 90 days after Client has submitted all necessary materials. If the Client does not supply WebDesignSentral with complete text and graphics content for this Web Design Project within 45 days of the effective date this agreement, the entire deposit amount of the agreement shall be retained by WebDesignSentral as liquidated damages and the contract shall become null and void, at WebDesignSentral' option, unless the Web Design Project is cancelled in writing by the Client prior to 45 days of the effective date of the agreement.
Project Delivery
The final web site design project will be published to the Client's hosting service upon receipt of final payment or delivered via CD by mail or email in a ZIP file upon the receipt of full payment. The Client understands that WebDesignSentral does not provide any hosting services in connection with this Web Design Project unless offered within the quote.
Payments
Payments must be made promptly based on the terms of the Web Site Design Project Quote which is provided to client via email link. WebDesignSentral reserves the right to remove any Web Design Project from viewing on the Internet until final payment is made. In case collection proves necessary, the Client agrees to pay all fees (including all attorney's fees and court costs) incurred by that process. This agreement becomes effective only when quote has been accepted by client and client pays initial deposit. The Client agrees that for purposes of venue, this agreement was entered into in Oslo, Norway, and any dispute will be litigated or arbitrated in Oslo, Norway, and the Client hereby consents to the personal jurisdiction of the Norwegian Courts. Furthermore, the Client waives any right to or claim of sovereign immunity.
Payment Schedule
WebDesignSentral requires a deposit up front and then the balance is due just prior to project completion or posting live to the web. Upfront deposit is determined per project, client deposit amount will be shown when quoting for the project. WebDesignSentral accepts all major credit cards, visa/mc debit cards online or regular checks & money orders via mail. By making a deposit you are accepting WebDesignSentral's quote and the agreement terms on this page. All amounts must be in U.S. Dollars. On some occasions a payment plan on the balance due may be accepted by WebDesignSentral but must be requested by client prior to project acceptance and start and must be confirmed and arranged by WebDesignSentral prior to start of project.
Refunds
If you make a deposit payment and then cancel the project before WebDesignSentral begins working on your project then WebDesignSentral will refund your deposit via paypal.com payment within 60 days. Deposits are non refundable once the project has started or is in progress.
Web Hosting
Client can choose to host website with WebDesignSentral or with another Hosting service.
Search Engines
WebDesignSentral does not guarantee where the clients' website ranks in search engines and directories.
Assignment of Web Design Project
WebDesignSentral reserves the right, and you hereby agree, to assign subcontractors to this Web Design Project to insure that the terms of this agreement are met as well as on-time completion.
Accessibility and Validation
WebDesignSentral develops website and web pages so the content and functions built into the web site are available to the majority of visitors. WebDesignSentral does not guarantee the sites to be error free or to pass any 3rd party validation or disability compliance check tools. If Client needs the website coding to pass W3C or Disability complains and validations the client must request to WebDesignSentral that disability compliance or validation coding be including in the quotation as an add-on service.
Teaching
While WebDesignSentral does advise client in the web design project, it is not WebDesignSentral's responsibility to teach client of web design and development techniques, practices or coding.
Legal Notice
Not withstanding anything to the contrary contained in this contract, neither WebDesignSentral nor any of its employees or agents, warrant that the functions contained in the Web Design Project will be uninterrupted or error-free. The entire risk as to the quality and performance of the Web Design Project is with the Client. In no event will Outsmart360 and/or WebDesignSentral be liable to the Client or any third party for any damages, including, but not limited to, service interruptions caused by Acts of God, the Hosting Service or any other circumstances beyond our reasonable control, any lost profits, lost savings or other incidental, consequential, punitive, or special damages arising out of the operation of or inability to operate this Web Design Project, failure of any service provider, of any telecommunications carrier, of the internet backbone, of any internet servers, your or your site visitor's computer or internet software, even if WebDesignSentral has been advised of the possibility of such damages.
Indemnification
The Client shall indemnify WebDesignSentral and Outsmart360 against and hold WebDesignSentral and Outsmart360 harmless from any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities including attorney's fees, claimed by any person, organization, association or otherwise arising out of, or relating to, the web pages and the websites creation or hosting, use, possession, operation and/or condition. The provisions of this paragraph shall survive the termination of this agreement and terms of service.
This Agreement
This agreement constitutes the sole agreement between WebDesignSentral and the Client regarding this Web Design Project. Any additional work not specified in the quote or any other amendment or modification to this contract must be authorized by a written request signed by both Client and WebDesignSentral.
This Agreement constitutes the entire understanding of the parties.

In the event of a conflict between any service agreement or other terms and this policy, the terms of this policy will govern. Introduction
WebDesignSentral.com provides a variety of Internet services ("WebDesignSentral.com Services"). For businesses and telecommuters, WebDesignSentral.com® Services provide a platform for website and hosting solutions and networked business applications.
Use of the WebDesignSentral.com Services is subject to the following rules and guidelines. Each customer of WebDesignSentral.com or its distribution affiliates is responsible for ensuring that the use of all Services provided to such customer complies with this Acceptable Use Policy (the "Policy"). ANY CUSTOMER WHO DOES NOT AGREE TO BE BOUND BY THESE TERMS SHOULD IMMEDIATELY STOP USE OF THE SERVICES AND NOTIFY WebDesignSentral.com ACCOUNT MANAGEMENT SO THAT THE CUSTOMER'S SERVICE CAN BE CANCELLED.
Illegal Activity
Use of WebDesignSentral.com Services for any activity that violates any local, state, federal or international law, order or regulation is a violation of this Policy:
- Prohibited activities include, but are not limited to
- Posting or disseminating material which is unlawful (such as child pornography or obscene material)
- Disseminating material that violates the copyright or other intellectual property rights of others. You assume all risks regarding the determination of whether material is in the public domain
- Pyramid or other illegal soliciting schemes
- Any fraudulent activities, including impersonating any person or entity or forging anyone else's digital or manual signature
Security
You are responsible for any misuse of WebDesignSentral.com Services that you have contracted for, even if the inappropriate activity was committed by an employee, customer, consultant, guest, hacker or other individuals who accesses your host space. Therefore, you must take steps to ensure that others do not gain unauthorized access to WebDesignSentral.com's Services. This includes any third party use of unsecured mail and news servers or any other unauthorized access that results in a violation of any portion of this Policy.
WebDesignSentral.com Services may not be used to breach the security of another Internet user or to attempt to gain access to any other person's or business's computer, software or data, without the knowledge and consent of such person or business. The Services also may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a web space or server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools, is prohibited.
You may not disrupt WebDesignSentral.com's Services. You are solely responsible for the security of any device you choose to connect to WebDesignSentral.com's Services, including any data stored on that device. WebDesignSentral.com recommends that any files or services you do choose to make available for remote access be protected with a strong password or as otherwise appropriate.
Electronic Mail
WebDesignSentral.com Services may not be used to send unsolicited, bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political, sexual or religious messages. Such messages may only be sent to those who have explicitly requested them. WebDesignSentral.com Services may not be used to send messages to any individual who has indicated that he/she does not wish to receive messages from you.
WebDesignSentral.com Services may not be used to collect responses from unsolicited email sent from accounts on other Internet hosts or email services which violates this Policy or the acceptable use policy of any other Internet service provider. Moreover, unsolicited email may not direct the recipient to any web site or other resource which uses WebDesignSentral.com Services. Forging, altering or removing electronic mail headers is prohibited.
"Mail bombing" is prohibited. That is, you may not send numerous copies of the same or substantially similar messages, nor may you send very large messages or files to a recipient with the intent to disrupt a server or account. The propagation of chain letters is similarly prohibited, whether or not the recipient wishes to receive such mailings.
WebDesignSentral.com is not responsible for the forwarding of email sent to any customer's service which has been suspended or terminated. Such email will either be returned to sender, ignored, deleted, or stored temporarily at WebDesignSentral.com's sole discretion.
Any violation of this policy will result in immediate termination of your account and the forfeiture of any hosting fees already paid.
Internet Relay Chat
WebDesignSentral.com Services may be used to participate in "chat" discussions. In all cases, WebDesignSentral.com does not normally monitor the contents of the discussion and is not liable for the contents of any communications made via Internet chat.
WebDesignSentral.com Services may not be used to perform chat "flooding." Flooding is defined as deliberately repeating actions in quick succession in order to fill the screens of other Internet users with text.
Forging, altering, or obscuring your identity (other than using a nickname from which WebDesignSentral.com could if necessary determine your real name) while participating in chat sessions is forbidden.
Bandwidth, Data Storage and Other Limitations
You must comply with the then current bandwidth, data storage and other limitations on WebDesignSentral.com Services.
Users must ensure that their activity does not improperly restrict, inhibit, or degrade any other user's use of WebDesignSentral.com Services, nor represent (in the sole judgment of WebDesignSentral.com) an unusually large burden on the network itself. In addition, users must ensure that their activity does not improperly restrict, inhibit, disrupt, degrade or impede WebDesignSentral.com's ability to deliver our Services and monitor our Services, backbone, and/or other host services.
Termination of Service and Limitation of Liability
WebDesignSentral.com reserves the right to terminate service of any account on either our shared, co-location or dedicated servers for any reason. By signing up for WebDesignSentral.com Hosting services, you the client agree to hold WebDesignSentral.com completely free from any and all liability related to both the operation and termination of services including but not limited to loss of revenue, loss of access to resources, security breach of sensative information, costs associated with transfering the account to another provider, repair cost, hacks or other malicous server attacks, or development costs.
Violation of Acceptable Use Policy
WebDesignSentral.com does not routinely monitor the activity of services used by customer for violation of this Policy. However, in our efforts to promote good citizenship within the Internet community, we will respond appropriately if we become aware of inappropriate use of our Services. Although WebDesignSentral.com has no obligation to monitor Services provided and/or the network, WebDesignSentral.com and it various affiliates and partners reserve the right to monitor bandwidth, usage, and content from time to time to operate our Services; to identify violations of this Policy; and/or to protect the network and WebDesignSentral.com customers.
WebDesignSentral.com prefers to advise customers of inappropriate behavior and any necessary corrective action. However, if our Services are used in a way which WebDesignSentral.com or its distribution affiliates, in their sole discretion, believe violate this Policy, WebDesignSentral.com or its distribution affiliates may take any responsive actions they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of Services provided by WebDesignSentral.com. Neither WebDesignSentral.com nor its distribution affiliates will have any liability for any such responsive actions. The above described actions are not WebDesignSentral.com's exclusive remedies and WebDesignSentral.com may take any other legal or technical action it deems appropriate.
The failure of WebDesignSentral.com or its distribution affiliates to enforce this Policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time. You agree that, if any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect. This Policy shall be exclusively governed by, and construed in accordance with, the laws of Norway.
